The domain name www.navaharitakapanyavithika.com and the mobile application “Panyavithika” is owned by the firm Panyavithika, ("Panyavithika") Provides this website & mobile application (the "site") to you subject to these terms and conditions of use (these “site & applications terms"). Please read these site & application terms carefully, By accessing or using the Panyavithika website, the Panyavithika service, or any applications (including mobile applications) made available by Panyavithika(together, the "Service"), however accessed, you agree to be bound by these terms of use ("Terms of Use"). The Service is owned or controlled by Panyavithika ("Panyavithika").

Terms of Use affect your legal rights and obligations. If you do not agree to be bound by all of these Terms of Use, do not access or use the Service.

There may be times when we offer a special feature that has its own terms and conditions that apply in addition to these Terms of Use. Basic Terms




  1. You must be at least 18 years old to use the Service.
  2. You may not post violent, nude, partially nude, discriminatory, unlawful, infringing, hateful, pornographic or sexually suggestive photos or other content via the Service
  3. You are responsible for any activity that occurs through your account and you agree you will not sell, transfer, license or assign your account, followers, username, or any account rights. You also represent that all information you provide or provided to Panyavithika upon registration and at all other times will be true, accurate, current and complete and you agree to update your information as necessary to maintain its truth and accuracy
  4. You agree that you will not solicit, collect or use the login credentials of other Panyavithika users
  5. You must not defame, stalk, bully, abuse, harass, threaten, impersonate or intimidate people or entities and you must not post private or confidential information via the Service, including, without limitation, your or any other person's credit card information, social security or alternate national identity numbers, non-public phone numbers or non-public email addresses.
  6. You may not use the Service for any illegal or unauthorized purpose. You agree to comply with all laws, rules and regulations applicable to your use of the Service and your Content (defined below), including but not limited to, copyright laws.
  7. You are solely responsible for your conduct and any data, text, files, information, usernames, images, graphics, photos, profiles, audio and video clips, sounds, musical works, works of authorship, applications, links and other content or materials (collectively, "Content") that you submit, post or display on or via the Service

  10. You must not create or submit unwanted email, comments, likes or other forms of commercial or harassing communications (a/k/a "spam") to any Panyavithika users
  11. You must not use domain names or web URLs in your username without prior written consent from Panyavithika
  12. You must not interfere or disrupt the Service or servers or networks connected to the Service, including by transmitting any worms, viruses, spyware, malware or any other code of a destructive or disruptive nature. You may not inject content or code or otherwise alter or interfere with the way any Panyavithika page is rendered or displayed in a user's browser or device.
  13. You must comply with Panyavithika Community Guidelines
  14. You must not create accounts with the Service through unauthorized means, including but not limited to, by using an automated device, script, bot, spider, crawler or scraper.
  15. You must not attempt to restrict another user from using or enjoying the Service and you must not encourage or facilitate violations of these Terms of Use or any other Panyavithika terms.
  16. Violation of these Terms of Use may, in Panyavithika’s sole discretion, result in termination of your Panyavithika account. You understand and agree that Panyavithika cannot and will not be responsible for the Content posted on the Service and you use the Service at your own risk. If you violate the letter or spirit of these Terms of Use, or otherwise create risk or possible legal exposure for Panyavithika we can stop providing all or part of the Service to you
  17. You agree and confirm that you will have to pay refundable deposit, processing fee and other applicable charges if any for authorizing yourself before making any order.
  18. You agree and confirm that there will be fixed rates only for vegetables and fruits for one to two months.
  19. You agree and confirm that there will not be a condition of minimum amount for prime customers only and for others such as regular or wholesale customers there will be a condition of minimum order amount for every single order, the minimum single order amount will be decided from time to time.
  20. You agree and confirm that delivery of orders will be disorganized in case of natural calamities like heavy rainfall, floods, storms, earthquakes etc. or in case of man-made hurdles/mistakes like accident, strike, movement, curfew etc. And this can not be informed prior.
  21. You agree and confirm that all the products ordered will be delivered as per their availability and amount if paid already for non-delivered products will be build and credited in due course of time.
  22. You agree and confirm that it will not be possible to give prior intimation of non-availability of any or all of the product in the list.
  23. You agree and confirm that if you reject to accept the order without any valid reason then you will be charged fully.
  24. You agree and confirm that if you or your representative is not available to accept the order, you will be charged for full order
  25. You agree and confirm that you or your representative will responsible to check the products and their quality, delivered as per your order, at the time of delivery.
  26. You agree and confirm that you will be responsible for decomposition of perishable products you received as per your order, due to improper handling, improper storage etc.
  27. You agree and confirm that your account will be suspended if you refuse to accept three consecutive orders.
  28. You agree and confirm that the amount of refundable deposit will be refunded without interest and by deducting all outstanding dues and other charges applicable from time to time within one month from your receipt of application.
  29. You agree and confirm that your order will be delivered at ground floor if you reside in a building of height more than ground plus one floor and orders in your building are less than twenty on the day.

General Conditions




  1. These Site Terms do not alter in any way the terms or conditions of any other agreement you may have with Panyavithika or its affiliates for products, services or otherwise. Panyavithika reserves the right to change or modify any of the terms and conditions contained in these Site & Mobile Application Terms, or any policy or guideline of the Site & Mobile Application, at any time and in its sole discretion without any prior notification to you. Unless otherwise specified, any changes or modifications will be effective immediately upon posting of the revisions on the Site & Mobile Application, and your continued use of the Site or Mobile Application will constitute your acceptance of such changes or modifications. You should review the Site & Mobile Application Terms and its incorporated policies and documents from time to time to understand the terms and conditions that apply to your use of the Site & Mobile Application. If you do not agree to any amended terms, you must stop using the Site and Mobile Application Service.
  2. We reserve the right to modify or terminate the Service or your access to the Service for any reason, without notice, at any time, and without liability to you If we terminate your access to the Service/deactivate your account, your photos, comments, likes, friendships, and all other data will no longer be accessible through your account (e.g., users will not be able to navigate to your username and view your photos), but those materials and data may persist and appear within the Service (e.g., if your Content has been re-shared by others).
  3. Upon termination, all licenses and other rights granted to you in these Terms of Use will immediately cease
  4. We reserve the right to force forfeiture of any username for any reason without any prior notification.
  5. We may, but have no obligation to, remove, edit, block, and/or monitor Content or accounts containing Content that we determine in our sole discretion violates these Terms of Use.
  6. You are solely responsible for your interaction with other users (including Members & Vendors) of the Service, whether online or offline. You agree that Panyavithika is not responsible or liable for the conduct of any user. Panyavithika reserves the right, but has no obligation, to monitor or become involved in disputes between you and other users. Exercise common sense and your best judgment when interacting with others, including when you submit or post Content or any personal or other information.
  7. There may be links from the Service, or from communications you receive from the Service, to third-party web sites or features. There may also be links to third-party web sites or features in images or comments within the Service. The Service also includes third-party content that we do not control, maintain or endorse. We prohibit crawling, scraping, caching or otherwise accessing any content on the Service via automated means, including but not limited to, user profiles and photos (except as may be the result of standard search engine protocols or technologies used by a search engine with Holiday Dreamland’s express consent).
  10. Use of Chat Rooms, Bulletin Boards and Other Interactive AreasThe Site & Mobile Application may contain discussion forums, bulletin boards, review services or other forums in which you or third parties may post reviews of your experiences or other content, messages, materials or other items on the Site ("Interactive Areas"). If Panyavithika provides such Interactive Areas, you are solely responsible for your use of such Interactive Areas and use them at your own risk. Please take note of the posting guidelines as contained in the Site & Mobile Applications. Further, by using any Interactive Areas, you expressly agree not to post, upload to, transmit, distribute, store, create or otherwise publish through the Site or Mobile Application any of the following:
    1. Any message, data, information, text, music, sound, photos, graphics, code or other material ("Content") that is unlawful, libelous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent or otherwise objectionable;
    2. Content that would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, state, national or international law, including, without limitation, the regulations of the Securities and Exchange Board of India or any rules of a securities exchange where the shares of the concerned entity have been listed such as the National Stock Exchange and the Bombay Stock Exchange;
    3. Content that may infringe any patent, trademark, trade secret, copyright or other intellectual or proprietary right of any party;
    4. Content that impersonates any person or entity or otherwise misrepresents your affiliation with a person or entity;
    5. Unsolicited promotions, political campaigning, advertising or solicitations;
    6. Private information of any third party, including, without limitation, addresses, phone numbers, email addresses, Social Security numbers and credit card numbers
    7. Viruses, corrupted data or other harmful, disruptive or destructive files
    8. Content that is unrelated to the topic of the Interactive Area(s) in which such Content is posted; or
    9. Content that, in the sole judgment of Panyavithika is objectionable or which restricts or inhibits any other person from using or enjoying the Interactive Areas or the Site, or which may expose Panyavithika or its affiliates or its users to any harm or liability of any type. Panyavithika takes no responsibility and assumes no liability for any Content posted, stored or uploaded by you or any third party, or for any loss or damage thereto, nor is Panyavithika liable for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography or profanity you may encounter. Rights




  1. By posting or distributing Content to or through the Site or Mobile Application, unless we indicate otherwise, you (a) grant Panyavithika and its affiliates a worldwide, nonexclusive, royalty-free, for the term of copyright and all renewals thereto, transferable, irrevocable and fully sub licensable right to use, reproduce, modify, adapt, translate, distribute, publish, create derivative works from and publicly display and perform such Content throughout the world in any media, now known or hereafter devised; (b) grant Panyavithika and its affiliates and sublicenses the right to use the name that you submit in connection with such Content, if they choose; and (c) represent and warrant that (i) you own and control all of the rights to the Content that you post or otherwise distribute, or you otherwise have the lawful right to post and distribute such Content to or through the Site; (ii) such Content is accurate and not misleading; and (iii) use and posting or other transmission of such Content does not violate these Site & Mobile Application Terms and will not violate any rights of or cause injury to any person or entity. You further grant Panyavithika the right to pursue at law any person or entity that violates your or Panyavithika’s rights in the Content by a breach of these Site or Mobile Application Terms.
  2. Content submitted by users (Including Registered Customers, Vendors and Suppliers) will be considered non-confidential and Panyavithika is under no obligation to treat such Content as proprietary information. Without limiting the foregoing, Panyavithika reserves the right to use the Content as it deems appropriate, including, without limitation, deleting, editing, modifying, rejecting, or refusing to post it. Panyavithika is under no obligation to offer you any payment for Content that you submit or the opportunity to edit, delete or otherwise modify Content once it has been submitted to Panyavithika. Panyavithika shall have no duty to attribute authorship of Content to you, and shall not be obligated to enforce any form of attribution by third parties.

  8. The Panyavithika name and logo are trademarks of Concerned Individual, and may not be copied, imitated or used, in whole or in part, without the prior written permission of that individual. In addition, all page headers, custom graphics, button icons and scripts are service marks, trademarks and/or trade dress of Panyavithika, and may not be copied, imitated or used, in whole or in part, without prior written permission from Panyavithika.
  9. Although it is Panyavithika's intention for the Service to be available as much as possible, there will be occasions when the Service may be interrupted, including, without limitation, for scheduled maintenance or upgrades, for emergency repairs, or due to failure of telecommunications links and/or equipment. Also, Panyavithika reserves the right to remove any Content from the Service for any reason, without prior notice. Content removed from the Service may continue to be stored by Panyavithika, including, without limitation, in order to comply with certain legal obligations, but may not be retrievable without a valid court order. If you believe in good faith that materials hosted by us infringe your copyright, please provide the written information requested below. The procedure outlined below is exclusively for notifying Panyavithika that your copyrighted material has been infringed.

Repeat Infringer Policy




In accordance with the Digital Millennium Copyright Act ("DMCA") and other similar applicable law, Panyavithika has adopted a policy of terminating, in appropriate circumstances and at Panyavithika’s sole discretion, subscribers or account holders who are deemed to be repeat infringers. Panyavithika may also at its sole discretion limit access to the Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

WITHOUT LIMITATION OF THE FOREGOING, NEITHER PANYAVITHIKA NOR ANY PARTIES PROVIDING SITE AND MOBILE APPLICATION CONTENT SHALL BE LIABLE FOR ANY DIRECT, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF PROFITS OR LOSS OF DATA, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING BUT NOT LIMITED TO NEGLIGENCE) OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THE SITE, THE SERVICES, THE CONTENT OR THE MATERIALS CONTAINED IN OR ACCESSIBLE THROUGH THE SITE, INCLUDING WITHOUT LIMITATION ANY DAMAGES CAUSED BY OR RESULTING FROM YOUR RELIANCE ON ANY SITE CONTENT OR OTHER INFORMATION OBTAINED FROM PANYAVITHIKA OR ACCESSIBLE VIA THE SITE OR MOBILE APPLICATION, OR THAT RESULT FROM MISTAKES, ERRORS, OMISSIONS, INTERRUPTIONS, DELETION OF FILES OR EMAIL, DEFECTS, VIRUSES, DELAYS IN OPERATION OR TRANSMISSION OR ANY FAILURE OF PERFORMANCE, WHETHER OR NOT RESULTING FROM ACTS OF GOD, COMMUNICATIONS FAILURE, THEFT, DESTRUCTION OR UNAUTHORIZED ACCESS TO PANYAVITHIKA'S RECORDS, PROGRAMS OR SERVICES. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF PANYAVITHIKA, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), PRODUCT LIABILITY, STRICT LIABILITY OR OTHER THEORY, ARISING OUT OF OR RELATING TO THE USE OF THE SITE EXCEED ANY COMPENSATION YOU PAY, IF ANY, TO PANYAVITHIKA FOR ACCESS TO OR USE OF THE SITE AND MOBILE APPLICATION. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Applicable Law and Venue




While Panyavithika has made no effort to publish the Site elsewhere, the Site is accessible in all countries. You and Panyavithika both benefit from establishing a predictable legal environment in regard to the Site. Therefore, you and Panyavithika explicitly agree that all disputes, claims or other matters arising from or relating to your use of the Site will be governed by the laws of the Government of India, without regard to its conflicts of law principles. You agree that all claims you may have against Panyavithika arising from or relating to the Site will be heard and resolved in a court of competent subject matter jurisdiction where the registered office of the firm is located. You consent to the personal jurisdiction of such courts over you, stipulate to the fairness and convenience of proceeding in such courts, and covenant not to assert any objection to proceeding in such courts. If you choose to access the Site from locations other than the jurisdiction specified above, you will be responsible for compliance with all local laws of such other jurisdiction.

Termination/Modification of License and Site Offerings




Notwithstanding any provision of these Site Terms, Panyavithika reserves the right, without notice and in its sole discretion, without any notice or liability to you, to (a) terminate your license to use the Site and mobile application, or any portion thereof; (b) block or prevent your future access to and use of all or any portion of the Site and Mobile application, Site and Mobile application Content or Services; (c) change, suspend or discontinue any aspect of the Site and Mobile application, Site and Mobile application Content or Services; and (d) impose limits on the Site and mobile application, Site and mobile application Content or Services.

Severability




If any provision of these Site and mobile application Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Site and mobile application Terms and shall not affect the validity and enforceability of any remaining provisions.

PAYMENT AND REFUND POLICY




You will have to make certain amount of payment as Refundable Deposit. Amount of Refundable Deposit will be depending upon the type of customer you opt to be and city/location you enter during registration and creating account at website or application for making order on "MAKE ORDER" platform.

Every authorized customer(Authorized customer is the customer who had paid the refundable deposit) will be getting credit of minimum 80% of his paid refundable deposit, for making order upto his credit limit without paying for every order, i.e if the unpaid bills of authorized customers orders reaches their credit limit they will have to make payment for their upto date unpaid bills before making next order. Thus again they receives credit for making next orders without paying for every order upto their credit limit.

Payment

We accept following payment options:

  • Online payment through debit card, credit card, net banking and wallet services
  • Online payment through UPI
  • Authorized Customers should pay the correct amount as in the invoice; we accept only Indian rupees.

All the Services and the Goods available on "OPT SERVICES" platform will be available free of any payment or refundable deposit for all registered customers.


Refund

If there is any refund, it might be routed through the same vendor as the payment was made for eg EBS or PAYU or Bank gate way etc. In such circumstances the refund is subject to third party processes on which we do not have any control. However, we can provide you the reference number/transaction id. If the payment was made directly to our Panyavithika bank a/c, then we will raise the refund through NEFT. The process will take maximum of 15 (fifteen) working days.

RETURNS POLICY




We are confidant, you will be happy with your purchase. However, should you feel it necessary to return an item, we aim to make the returns process as simple as possible.

  • No questions asked returns policy: On delivery if you are not happy with what you have received, you may return the items to the same delivery executive.
  • We cannot accept the return of perishable items like milk, milk products, vegetables, fruits etc due to our policy of delivering only fresh products and hygiene purposes.
  • Consecutive 3 order returns of perishable items will deactivate you from Panyavithika services, if we found you doing intentionally. Panyavithika reserve all rights to terminate your service without intimating you.
  • You can cancel the whole order on the time of delivery if you are not satisfied.
  • We do not allow acceptance of partial delivery, you must return all the items in your order.
  • We will not charge you for the goods you have received are incorrect or defective at the time of delivery. Over and above all the above conditions, Panyavithika might accept returns on case to case basis, which is on the goodwill, which is purely subject to the discretion of the Panyavithika Cancellation.
